Terms of Service

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for breeders operating a business and for buyers interacting with those breeders.

The Service

Whelpify provides software tools for breeder websites, waitlists, buyer accounts, applications and forms, in-app messaging, reservations, deposits and payments, notifications, custom domains, and related operations. We may add, change, or remove features over time. We are a software provider; we are not a party to any transaction, contract, or relationship between a breeder and a buyer.

Accounts and security

You are responsible for keeping your account credentials secure and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or disable accounts that pose a security or compliance risk.

Custom Website Builds

No card or payment is required to request a custom build. You can review the design and request changes before approving it. Your plan begins when you approve the website and confirm subscription checkout with your payment details. Eligible monthly plans start with a 30-day trial. Annual plans are paid at that point and do not include a trial. You can withdraw a build request before approving the design. Choosing self-service starts your plan when you confirm checkout instead.

Free trials

Where a plan is offered with a free trial, the trial length is shown at checkout. Your subscription begins billing automatically when the trial ends unless you cancel before then. One free trial is available per business and per payment method. To enforce this, we keep a one-way hashed fingerprint of the payment method used to start a trial; a second trial started with the same payment method is canceled. If you manage more than one business, contact us and we will set you up.

Breeder responsibilities

Breeders are solely responsible for:

• the content, photos, descriptions, pricing, and breeding-program information they publish, and its accuracy and legality;
• their communications, contracts, disclosures, health guarantees, and refund and cancellation policies with buyers;
• their animal-care, welfare, licensing, consumer-protection, advertising, tax, and other legal and regulatory obligations;
• obtaining any required consents from buyers and handling buyer data they collect in accordance with applicable law (Whelpify acts as a processor for that data);
• emailing only people who asked to hear from them, such as their own waitlist, and honoring requests to stop; and
• honoring the payment, deposit, and refund terms they set for their buyers.

Acceptable use

You agree not to use the Service to:

• violate any law or the rights of others;
• post false, fraudulent, infringing, or harmful content;
• attempt to gain unauthorized access to the Service, other users' data, or related systems;
• interfere with or disrupt the integrity or performance of the Service;
• send unsolicited email or messages through the Service;
• misrepresent animals, health status, or pricing, or engage in deceptive practices toward buyers; or
• create extra accounts, use other people's payment methods, or otherwise game a free trial, promotion, or the referral program.

Payments, plans, and breeder and buyer transactions

Subscription plans for the Service are billed through our payment processor, Stripe. Fees are described at sign-up or on our pricing page and, unless stated otherwise, are recurring and non-refundable except as required by law. You can cancel a subscription from your account's billing settings; cancellation stops future charges but does not refund amounts already billed.

If your checkout identifies a founder rate, that rate remains available while the subscription stays continuously active. Canceling ends the founder-rate lock; a later restart uses the pricing offered at that time. Annual plans renew yearly at the amount and cadence shown during checkout unless canceled before renewal.

If a payment fails, we will let you know by email and in your dashboard, and Stripe will retry the charge. Your site stays online while the payment is being retried. If the subscription is canceled or becomes unpaid, your public site goes offline until billing is restored. Your data is kept while the site is offline so you can pick up where you left off.

Payments between breeders and buyers (such as deposits and balances) are processed through the breeder's own connected Stripe account or through offline methods the breeder configures. Whelpify does not hold these funds and is not responsible for breeder and buyer payments, refunds, chargebacks, or disputes, which are the breeder's responsibility.

If you buy a domain through Whelpify, the price and initial registration term are shown before payment. Domain registrations and completed renewal charges are non-refundable except where required by law. When auto-renewal is on, you authorize Whelpify to charge your saved payment method at the yearly renewal price shown during checkout. You can turn auto-renewal off from your Domain settings; cancellation stops future renewal charges but does not reverse a registration or renewal already paid. If a renewal payment fails, auto-renewal is paused and we will let you know.

Plans include one standard .com registration for the first year, available after the first successful annual payment or two successful monthly plan payments while the plan is active. If you buy an eligible one-year .com through Whelpify before qualifying, its registration cost is credited automatically toward a subsequent Whelpify plan invoice once you qualify. Unused credit carries forward. This replaces the free registration benefit and is not a cash refund. Premium names, domains bought elsewhere, renewal fees, transfers, refunded purchases, and disputed payments are excluded.

Referral program

When the referral program is available in your account, you get a personal referral link to share. A referral counts when a new breeder signs up through your link and pays their first subscription invoice. Rewards are credit toward your own Whelpify subscription, applied automatically to your future bills. Reward tiers and any "free for life" benefit are described in your dashboard and may change for referrals made after a change is announced.

• Rewards have no cash value, cannot be transferred, and cannot be paid out.
• To earn rewards, your own subscription must be active and in good standing. Only the subscription on record for your site can earn or use rewards.
• If a referred breeder's payment is refunded, disputed, or reversed, the reward for that referral is removed. Credit already applied to a bill is not clawed back from you, but unused credit from that referral is.
• Referring yourself, a business you control, or accounts that share a payment method or identity is not allowed. We review referrals that look related before any reward is granted.
• We may revoke any referral or reward, decline to grant one, or remove a breeder from the program at any time and for any reason, including suspected abuse, and we will tell you in your dashboard when we do. We may also change or end the program at any time; rewards already applied to a bill stay applied.

Forms, contracts, and typed signatures

Breeders can build applications, questionnaires, and contract-style forms that buyers complete on the breeder's site. A signature field records the name the buyer typed, together with the form's submission time and any date field the breeder included. Whelpify does not verify identity and does not provide an independent signing audit trail. Breeders are responsible for deciding whether a typed signature is sufficient for their agreements and for the content and enforceability of those agreements.

Third-party services

The Service is built on third-party providers, including Stripe (billing and breeder payouts), Vercel (hosting and domain registration), Neon (database), Cloudflare (bot protection, media storage, and image delivery), Resend (email delivery), Upstash (abuse controls), Google (optional analytics), and Meta (advertising measurement on our marketing pages, and Facebook and Instagram posting if a breeder connects it). Your use of an integration you connect is also subject to that third party's terms and policies. We are not responsible for third-party services.

Content and intellectual property

You retain ownership of the content you upload or create. You grant Whelpify a worldwide, non-exclusive license to host, store, process, display, and transmit your content as needed to operate and provide the Service. Whelpify and its licensors own the Service itself, including its software, design, and trademarks. You may not copy, modify, or reverse engineer the Service except as permitted by law.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, Whelpify will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amounts you paid to Whelpify for the Service in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold Whelpify harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, your transactions or relationships with buyers, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or other users. Breeders can export their waitlist, customer, payment, and offer records from the dashboard at any time. To have an account and its data deleted, email us; there is no self-serve delete button today. Provisions that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, and indemnification) will survive.

Changes to the Service and these Terms

We may modify the Service or these Terms from time to time. When we make material changes to these Terms, we update the effective date above, post a short summary of what changed at the top of this page, and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You and Whelpify agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute arising out of these Terms or the Service, to the extent permitted by law.
